天天好bThe Supreme Court on Thursday upheld the government's power to arrest, question and quickly remove immigrants who are caught crossing the border illegally.

In a victory for the Trump administration, the justices rejected the claim that immigrants who seek asylum have a right to a full federal court review through a writ of habeas corpus, even if their claims are judged to be not credible.

The 7-2 decision came in the case of a Sri Lankan immigrant who was caught late at night 25 yards north of the border with Mexico near San Ysidro, Calif. He was interviewed by an asylum officer who concluded he did not have a "credible fear of persecution," which would trigger a further hearing. A supervisor and immigration judge agreed his claim did not deserve further review.

But last year, the U.S. 9th Circuit Court of Appeals issued a broad ruling in his case holding that the federal law authorizing "expedited removal" of border crossers was unconstitutional in cases such as his.

Lawyers for Vijayakumar Thuraissigiam, the Sri Lankan man, said due to "communication problems," the asylum officer did not learn of his full story. It included his being detained and beaten by army officers for supporting a Tamil political candidate. The 9th Circuit ruled it would violate the Constitution's right of habeas corpus and due process of law to deny a federal court review for such cases.

The Justice Department appealed and argued the ruling could unravel the "expedited removal" process set by Congress in 1996 and lead to a "flood" of lengthy appeals.

The Supreme Court agreed and reversed the 9th Circuit, ruling neither habeas corpus nor due process of law gives those who cross the border illegally a right to have a full review of their claims in the federal courts.

"While aliens who have established connections in this country have due process rights in deportation proceedings, the court has long ago held Congress is entitled to set the conditions for an alien’s lawful entry into this country and that, as a result, an alien at the threshold of initial entry cannot claim any greater rights" beyond those set in the 1996 law, said Justice Samuel A. Alito Jr. in Department of Homeland Security vs. Thuraissigiam. He was referring to the right to be interviewed by an asylum officer and a review by an immigration judge.

Over the last five years, 77% of those interviewed by an asylum officer were found to have a credible claim, he said. As a result, the "expedited removal" process is limited to one in four of those who make an asylum claim.

Alito said habeas corpus "has traditionally been a means to secure release from unlawful detention." In the case of the Sri Lankan man, "the government is happy to release him, provided the release occurs in the cabin of a plane bound for Sri Lanka," he said. But instead of seeking his release, the migrant's goal is "to obtain authorization to stay in this country."

The 9th Circuit had cited the high court's rulings extending habeas corpus rights to the detainees at Guantanamo Bay in Cuba, but Alito said those detainees sought to be released and go home, not permission to live in the United States.

Justices Stephen G. Breyer and Ruth Bader Ginsburg concurred in the result, but did not join Alito's opinion.

Justices Sonia Sotomayor and Elena Kagan dissented. "Today's decision handcuffs the judiciary’s ability to perform its constitutional duty to safeguard individual liberty and dismantles a critical component of the separation of powers. It will leave significant exercises of executive discretion unchecked [and] increases the risk of erroneous immigration decisions that contravene governing statutes and treaties," Sotomayor wrote.

ACLU attorney Lee Gelernt, who argued the case, said he was disappointed.

“This ruling fails to live up to the Constitution’s bedrock principle that individuals deprived of their liberty have their day in court, and this includes asylum seekers. This decision means that some people facing flawed deportation orders can be forcibly removed with no judicial oversight, putting their lives in grave danger," he said.

It’s been a month since the police killing of George Floyd sparked mass protests across the United States and compelled various prominent Democrats and Republicans, including Donald Trump himself, to vow serious action and police reform. In that time, the president has lost interest in doing much of anything about it, according to two people who’ve discussed the matter with him in recent days.

“He’s done with that,” one of the sources said. 

Never known for his sustained focus, the president’s mind has been particularly adrift this week, wandering to various tangential topics such as the desire to defend monuments and statues—particularly those honoring racist and Confederate figures of history—from being torn down by protesters. Late Monday night, Trump took to Twitter and began posting videos of random Black men attacking a white man and a woman, lamenting why social and racial justice protesters in America weren’t out in the streets about that instead. By Thursday morning, he was accusing leaders of the Black Lives Matter movement of treason and insurrection.

And he’s already signalled that should nothing on police reform get done, he will simply heap blame on his political enemies. When asked about the Senate reform bill on Wednesday, the president told reporters it would be nice if it were to pass but then accused Democratic politicians of wanting to “take away a lot of the strength from our police.”

Trump’s interest in police reform always appeared to be fleeting. But early on after the Floyd killing became national news, the White House put together stakeholder meetings and solicited ideas to create some sort of reform framework. Trump himself met with law enforcement officials and family members of victims of police killings.

But the president grew impatient. In mid-June, he signed an executive order that fell far short of what numerous reform advocates and protesters have been calling for, but did offer grant incentives to departments that increased their police training on use of force.

At that point, said the source who discussed the issue with Trump, the president believed he was basically done. “He believes his executive [order] was a home run,” the source said.

Alas, few feel the same way. But progress on filling in the massive gaps has proved difficult for lawmakers on the Hill and the window to craft a compromise has likely shut for the time being, possibly until after the election.

Democrats and Republicans’ dueling proposals, rolled out within days of each other earlier this month, had areas of common ground. But the Senate GOP bill, led by Sen. Tim Scott (R-SC), does not include several reforms that Democrats consider must haves, including an outright ban of the kind of chokehold that Minneapolis cop Derek Chauvin used to kill Floyd; a ban on the no-knock serving of warrants that led to Breonna Taylor’s killing by cops in Kentucky; or anything related to qualified immunity, which can shield officers from lawsuits stemming from their conduct on the job.

Instead, the Senate GOP bill emphasizes various areas of additional training for police officers and would establish a national database of cops’ records so that police departments know if potential hires have records of misconduct. The bill would also make lynching a federal hate crime.

Civil liberties groups have panned the measure, with the American Civil Liberties Union saying it “throws billions of dollars at studies and commissions when we know the real problem at the core of American policing.” And congressional Democrats have insisted that their House legislation should be the barometer for reform—Congressional Black Caucus chair Rep. Karen Bass’s (D-CA) bill, which passed the chamber on Thursday, addresses all the areas that Scott’s does not. They also say they are keenly aware that, no matter what happens, Trump will tout his own executive order as the be-all, end-all solution to police brutality.

“Regardless of how little Republicans actually do, how many more Black Americans are murdered or how many dog-whistles Trump sends, he will lie and claim he alone solved the problem,” said a Senate Democratic aide.

But Republicans like House GOP Leader Kevin McCarthy (R-CA) have accused Democrats of wanting to defund the police and “push[ing] bills that will make our officers less safe.” And Senate Majority Leader Mitch McConnell (R-KY) has argued that Democrats should focus on simply improving their chamber’s bill through the amendment process. Both he and congressional Republicans have aggressively blasted what they see as Democrats’ obstructionism: Scott, the Senate GOP’s only Black member, sought to torch Democrats in a floor speech Wednesday, arguing that they didn’t want to do anything now but instead wait until after the November elections to see if they won back the White House and the Senate, a feeling that is widely shared within the Senate GOP ranks.

Democrats, charged Scott, were working to “not allow this party to be seen as a party that reaches out to all communities in this nation.”

With negotiations coming to near a standstill, the White House could play a role in brokering some sort of compromise. But, so far, the president’s team has shown no interest in that route. 

“The White House is behind Sen. Tim Scott’s bill, we’ve made that clear,” said a senior administration official. “The president acted, and acted quickly, but we’ve more or less exhausted the options that could be done through an [executive order] and need the legislative branch to act.”

Trump’s absence from the talks comes as his own advisers recognize the debate over police reform, and racial justice matters more broadly, could have a significant impact on his reelection. And it’s taking place as some have privately attempted to get him to engage on the matter more, mindful that they could tag former Vice President Joe Biden with having helped create the criminal-justice pitfalls that are consuming the United States today. But according to three sources familiar with the discussions, there is growing frustration that Trump routinely jumps between adopting a “tough on crime” persona and trying to grab the mantle of a criminal justice reformer—never comfortable settling on just one. 

“He wants to have it both ways,” said one senior White House official.

  • Quentin Suttles, a 30-year-old Black man, is suing the city of Buffalo, New York, after a video surfaced showing police punching him in the head several times during a May arrest.

When Quentin Suttles, a 30-year-old Black man, was arrested on May 10, a bystander filmed an officer punching him in the head several times.

This week, an officer's body camera video, which shows the police interaction with him in full, was released. 

WKBW reporter Madison Carter shared the video on Twitter.

The five-minute video shows an officer searching Suttles' body, as he speaks to him in a firm, but conversational voice. 

As it goes on, though, Suttle can be seen being thrown to the ground. An officer punches him in the head repeatedly, and Suttles is heard whimpering, pleading for his partner to record what was happening.

"You can't hit him like that," a woman yells as two Buffalo, New York, police officers are leaned on top of him, one of them striking him in the head.

"He's trying to eat the drugs," one of the officers yells back toward the woman.

Suttles then tells the officers, "I'm dying," and blood can be seen on the ground under his head.

Now the Erie County District Attorney District Attorney's office has launched an investigation into the incident and Suttles plans on suing the department and the city, local media — including WKBW and Buffalo News — have reported.

The police department has also opened an internal affairs investigation, according to Buffalo News.

An attorney for Suttles filed notice of the claim in the state's Supreme Court. It says that Buffalo Police Officers Ronald Ammerman and Michael Scheu used excessive force when they pulled him over and arrested him.

The claim also accuses the city, the police department, and Buffalo Police Commissioner Byron Lockwood of not properly training officers in use of force and not providing adequate supervision of their actions, according to WKBW.

Police said in their report, which was obtained by WKBW, that they pulled Suttles over after smelling a strong odor of marijuana and observing him driving "the wrong way." 

"While conducting pat down, searched defendant did push off vehicle and fight with officers," the police report states, according to the station. "Defendant continued to fight and reach in his pants, ignoring officers command to stop resisting."

WKBW reported that the officers also said they recovered a white powder substance from Suttles' left pocket, and that he had tried to destroy drugs during the arrest.

The claim by Suttles' attorney Joshua Ramos, though, accuses the officers of  "prolonged grabbing of his genitals while finding no contraband." 

Suttles suffered a fractured shoulder blade and orbital bone as a result of the incident, according to legal papers viewed by Buffalo News. 

Despite the injuries, police didn't seek medical treatment for Suttles the next day, Ramos said in the claim viewed by Buffalo News. 

Ramos gave a copy of the suit to local media outlets on Thursday, according to the News. The claim could not be found on the state's Supreme Court online database Friday.

In May, when Buffalo Mayor Byron W. Brown first saw the cellphone video taken at the scene, he said he was concerned with police actions. 

"As Mayor of the City of Buffalo, a very diverse city, I am sensitive to any instances of conflict between members of our community and our police department," Brown said in a statement released at the time. "Like others, I am concerned by what I saw on that video, however, I do not have all of the facts regarding this situation."

WASHINGTON (AP) — President Donald Trump signed an executive order Friday to protect monuments, memorials and statues facing new scrutiny amid fresh debate over the nation's racist beginnings.

Trump had promised to take action earlier this week after police thwarted an attempt by protesters to pull down a statue of Andrew Jackson in a park across from the White House.

The order calls on the attorney general to prosecute to the fullest extent of the law any person or group that destroys or vandalizes a monument, memorial or statue. Federal law authorizes a penalty of up to 10 years in prison for the “willful injury” of federal property.

The order also calls for maximum prosecution for anyone who incites violence and illegal activity, and it threatens state and local law enforcement agencies that fail to protect monuments with the loss of federal funding.

Trump announced earlier Friday on Twitter that he had signed the order and called it “strong.”

Earlier in the day, the president used Twitter to call for the arrest of protesters involved with the attempt to bring down the Jackson statue from Lafayette Park.

He retweeted an FBI wanted poster showing pictures of 15 protesters who are wanted for “vandalization of federal property."

Trump wrote, “MANY people in custody, with many others being sought for Vandalization of Federal Property in Lafayette Park. 10 year prison sentences!”

He also said on Twitter that he had scrapped plans to spend the weekend at his central New Jersey home to stay in Washington “to make sure LAW & ORDER is enforced.”

“These arsonists, anarchists, looters, and agitators have been largely stopped," Trump tweeted. "I am doing what is necessary to keep our communities safe — and these people will be brought to Justice!"

Protesters on Monday night attempted to drag the Jackson statue down with ropes and chains. Police repelled the protesters and sealed off Lafayette Park, which had been reopened to the public for more than a week after protests against the death of George Floyd at police hands in Minnesota. On Tuesday, police cleared out the entire area around the corner of 16th and H streets — and pushed demonstrators away from the intersection, which had recently been renamed Black Lives Matter Plaza by the city.

Statistics released by the Metropolitan Police Department show that nine people were arrested Tuesday night and a total of 12 arrested between Monday and Wednesday. There were no protest-related arrests Thursday, according to the MPD data.

Demonstrators have grown increasingly emboldened about targeting statues deemed offensive or inappropriate. On June 19, or Juneteenth, the day marking the end of slavery in the United States, cheering crowds puled down a statue of Confederate Gen. Albert Pike. The statue stood on federal land and had withstood previous attempts by the Washington, D.C., government to remove it. According to participants, police officers were on the scene but did not attempt to interfere.

The targeting of the statues has become a rallying cry for Trump and other conservatives. Immediately after the Pike statute was toppled and set ablaze, Trump called the incident a "disgrace to our Country!” on Twitter.

On Tuesday he tweeted, “I have authorized the Federal Government to arrest anyone who vandalizes or destroys any monument, statue or other such Federal property in the U.S. with up to 10 years in prison, per the Veteran’s Memorial Preservation Act, or such other laws that may be pertinent.”

Glastonbury Tor has been named as one of Britain's most popular picnic hotspots.

Meeting other people for a socially distant picnic in a park has become a popular past time since coronavirus lockdown measures were eased.

In celebration of National Picnic Week, Leisure Range Cookers has complied a list of the nation's favourite picnic foods, as well as the top locations full of picturesque picnic spots.

Leisure Range Cookers has used National Trust locations and analysed TripAdvisor ratings to reveal where in the UK has the most picnic spots, as well as which ones come out on top.

Their study found Glastonbury Tor was the seventh most popular picnic hotspots and beat the likes of Stourhead and Calke Abbey.

The top sandwich filling could be somewhat divisive as tuna mayonnaise is revealed as the most popular with 22.9 per cent of people in the UK naming it as their favourite.

For those who are heading out for a picnic, it is advised that people follow social distancing measures and sanitise hands to stop any spread of germs.

People are also advised to bring their own picnic blankets and food and avoid sharing items with other people.

The U.S. military is in jeopardy of falling behind Russia and China in some crucial areas of weapons and technology, including hypersonics, AI and quantum computing, according to senior Congressional leaders. 

Senator Jim Inhofe, Chairman of the Senate Armed Services Committee, issued a straightforward message to both Russia and China from the Senate floor June 25th while making a case for a strong 2021 military budget, flatly saying “there is no way you can defeat us—so don’t even try.” 

Inhofe provided a lot of detail about strategic, political, economic and military concerns regarding both Russia and China, citing massive increases in the military budgets of both countries. 

“China increased its military spending by 83 percent from 2009 to 2018. Over essentially the same time frame, Russia grew its defense budget by 35 percent,” Inhofe said. He made the point that Russian and Chinese military expansion was by no means limited to size and scope but, perhaps of equal or greater significance, massively invested in technological progress. 

“Last October, China paraded a hypersonic weapon, showing off a technology we don’t even have yet,” Inhofe said.

Inhofe offered a number of specific reasons why both China and Russia concerns are fast-growing at the Pentagon. Among the military’s worries are Chinese global economic and military expansion, such as Beijing’s incursions into Africa with the construction of a new military base right near U.S. forces in Djibouti. He also made a point to emphasize growing antagonistic behavior toward the United States, Taiwan and other allies in the Pacific region. 

Inhofe did not stop with the Pacific but also made reference to China’s killing of twenty Indians along the border in their recent clash, and criticized Russia’s support of the Assad regime in Syria. 

A strong, growing military budget prioritizing near-term modernization as well as longer-term oriented science and technology research are needed for the innovations to win any future war. Along these lines, Inhofe did say progress was being made with respect to a number of needed technical leaps forward, such as current weapons development efforts at Fort Sill, Oklahoma.

“Right now, we’re outranged and outgunned by Russia and China. Fort Sill is leading the Army’s modernization efforts on long-range precision fires to restore our combat advantage,” he said.

With this example, he was likely referring to the Army’s Extended Range Cannon Artillery and Precision Strike Missile programs engineered to massively expand the attack range and effectiveness of U.S. weapons systems. The ERCA, for example, has already fired 155m artillery close to 70km and Army developers have now fired three test shots of its Precision Strike Missile, a new weapon intended to fire as far as 500km. 

“The current missiles can go about 350 km and this will go beyond 500 km eventually. We are almost doubling the range with existing launchers so we are not having to invest in new launchers. We can now put two missiles in the launcher as opposed to what we can do now, which is one,” General John Murray, Commander, Army Futures Command, told TNI in a recent interview about the new weapon. 

In his remarks, Inhofe also expressed strong support for the House Armed Services’ Committee’s Indo-Pacific initiative, a legislative proposal seeking to add $6 billion in funds to step up U.S. weapons and forces in the Pacific. 

“We know that the way we preserve peace is by demonstrating our strength,” he said.

I’ve worked in five Republican presidential campaigns. Four won the nomination and two won the White House. It’s a presidential election summer but I am trying to do everything I can to help elect a Democrat: Joe Biden.

Another four years of Donald Trump would be a disaster for America and the world. They would also be a disaster, and likely fatal, for the Republican Party. The reality is that President Trump is a symptom, not the source, of the disease that is ravaging the Republican Party. Only by confronting that sickness can there be a possibility of a cure.

The Republican Party has lost its way

In 1956, Dwight Eisenhower got 36% of the African American vote. In 1964, that number fell to 6% for Barry Goldwater. One could have argued that once the Civil Rights bill, which Goldwater opposed, became law, many of those former Republican African Americans would return to the party. But it never happened, and Republicans have never come to grips with the reasons.

For decades, Republicans told themselves that African Americans would be drawn back to the party if only Republicans understood how to communicate with Black voters.

This launched a cottage industry of Black Republican consultants hired by the RNC to help white Republican candidates and campaigns deliver their message to non-white voters. “If you talk about ‘good’ jobs not just jobs, African Americans will hear you,” was a standard of these lessons.

It was all nonsense. African Americans heard Republicans clearly; they just didn’t like what they were hearing. The party that revered Ronald Reagan’s line, “The nine most terrifying words in the English language are ‘I’m from the government and I'm here to help,’” never realized that to many African Americans and lower income whites, the federal government was the last best hope for a better life.

After the 2012 election, Republican Party Chairman Reince Priebus commissioned a so-called “autopsy” to analyze the reasons the party had only won the popular vote once since 1988. The need to reach out to non-white voters, to appeal to younger voters and women was presented not just as a political necessity but a moral mandate for a governing party.

All of that was thrown aside a few years later when the party embraced the white grievance candidacy of Donald Trump. Trump didn’t bend the party to his will, he gave the party an excuse to quit pretending it really cared about anything but power.

Biden is right choice for Republicans

I’ve helped elect Republican governors or senators in over half the country, and I have given up any hope that there is some line Trump can cross to make more than a few Republicans in Congress stand for the principles they all swore to believe. The only way to save the Republican Party is to crush Trump and Trumpism and rebuild. It’s why I say, when I am asked what to do about the party I worked in for so long, “Burn it to the ground and start over.”

That starts with electing Joe Biden. Most importantly, Biden is a decent man with a seriousness of purpose that is totally lacking in the Trump administration. The alternative is four more years of a Republican Party that endorsed Roy Moore and stands silently by as Attorney General Bill Barr shreds the rule of law.

It is possible the party can squeeze out enough white voters and suppress enough non-white voters to eke out a victory for Trump.  But it is impossible for that party to grow and prosper beyond November 3rd.

Today in America over half of those 15 and under are non-white. There is good reason to believe that when they turn 18 they’ll register as Democrats. That is a stage four cancer warning for the Republican Party. Had George Wallace won the Democratic nomination and been embraced by the Democratic establishment, what would that have meant for the future of the party?

So it is with Republicans and Trump. We have a president and vice president who refuse to say the words “black lives matter” and seem more determined to defend Confederate statues than the Constitution.

I spent years working to defeat Bill Clinton, Al Gore, John Kerry and Barack Obama. In those battles, I passionately believed Bob Dole, George W. Bush and Mitt Romney would make better presidents, but I never feared for the country if a Democrat won. That’s how a civil society must function. But today I do desperately fear for the country if Trump wins, again. History tells us that once hate is unleashed and legitimized by a major political party, it is difficult to stop. History will judge each of us on what we did to defend America in this tenuous moment.

America or Donald Trump? That’s how this Republican sees the November choice. I say to my Republican friends: I know what side I’m on, do you?
